How to obtain relief from student loan debts
Basic stuff about student loans
When you finish your studies you have a 6 month grace period during which you are not required to make loan payments. If you find it difficult to make payments, you can apply to have your payments reduced. You might still find yourself burdened by these debts and others.
We can help you
Student loan debts are debts to the government. We can discuss your budget and your option of trying to pay back your debts, and show you the options that are only available through Licensed Insolvency Trustees, including consumer proposals and bankruptcy.
There are specific matters of which you must be aware.
Do you have a student loan?
Or is it a student line of credit, a repayable grant, a bank loan directed at students, or a loan from a non-Canadian lender? It matters.
When did you cease to be a student?
If you make a proposal or bankruptcy filing you will only be released from your student loan debt if the date of your filing is more than 7 years after you ceased to be a student, and you finish off your filing.
BC Court decision
If you resumed studies in any field even long after your student loan it is still possible you were a student in the last 7 years. This has been confirmed by the Supreme Court of BC. Going back to school will re-start the 7 year calculation. Were you a student in the last 7 years?
IF IT HAS BEEN MORE than 7 years
Then completing your proposal or obtaining your discharge from bankruptcy will release you from your student loan debts.
